ServiceTasker Canada – Terms & Conditions
Welcome to ServiceTasker Canada ("we", "us", “our”). These Terms & Conditions (“Terms”) govern your use of our website and services accessible at ServiceTasker.ca ("Platform"). Whether you're a customer requesting a service or a tradesperson offering one, by registering or using our platform, you agree to comply with these Terms.
1. Definitions
- “Platform” refers to the ServiceTasker website that connects customers and service providers.
- “Customer” means anyone using our platform to request services.
- “Tradesperson” means businesses or individuals registered on our platform offering services.
- “Services” refers to the trades, jobs, and tasks posted, accepted, and performed using our platform.
- “Credits” and “Lead Credits” are digital tokens used by Tradespeople to access job leads.
Other defined terms may be introduced throughout these Terms for clarity.
2. Who We Are & Scope
ServiceTasker operates as a marketplace—providing a connection point between Customers and tradespeople only. We do not provide the services ourselves, nor act as an agent or contractor for any service provider.
As the platform operator, our role is limited to facilitating the posting, matching, and rating of jobs; all Services and transactions are strictly between Customers and tradespeople.
3. Eligibility & Accounts
- You must be at least 18 years old to use ServiceTasker.
- Users must register and provide accurate, truthful, and current information. Tradespeople must include valid business information, licensure, and insurance where applicable.
- You are responsible for maintaining the privacy of your account credentials. You agree to notify us immediately of any unauthorised use.
4. User Conduct
Customers must:
- Post accurate job descriptions in the allowed categories.
- Behave respectfully and responsibly during interactions.
Tradespeople must:
- Provide accurate business profiles, including licensing, qualifications, and business registration certificates where required.
- Accept jobs only within your expertise, conduct proper trade practices, and maintain safety and compliance with Canadian laws.
All Users must not:
- Use the platform for illegal, deceptive, or harmful activity.
- Post prohibited content, spam, or attempt to bypass system checks.
- Misrepresent services or engage in misleading activity.
5. Services, Leads & Credits
- Customers can post job requests free of charge.
- Tradespeople can use Credits to unlock job leads.
- Credit Terms (purchase, use, refunds, expiry) are governed by our separate Credit Terms page.
6. Fees & Payments
- Customers pay tradespeople directly—ServiceTasker does not process or handle payment.
- Tradespeople purchase credits via wallet funds to access leads.
7. Tax Compliance
ServiceTasker is not responsible for your tax obligations. Tradespeople may need to collect and remit GST/HST or other provincial sales taxes depending on their location and revenue. If you're registered for GST/HST, invoices should include applicable tax breakdowns.
8. Intellectual Property Rights
- ServiceTasker retains all rights to platform content, software, and trademarks.
- Users retain rights over their own uploaded content (e.g., profile info, reviews), but grant us a perpetual license to display and use that content within the Platform.
- If you believe content breaches your rights, contact us with proper evidence.
9. Reviews & Ratings
- Reviews must be honest and based on actual service experiences.
- ServiceTasker may remove reviews that violate guidelines (defamatory, offensive, irrelevant).
- Tradespeople may respond to feedback professionally to build trust and resolve issues.
10. Limitation of Liability & Disclaimers
- The Platform is provided “as is” and “as available.”
- We disclaim all warranties—express or implied—of merchantability or fitness for a particular purpose.
- ServiceTasker is not liable for the performance, liability, loss, or damage caused by service providers.
- Our liability to you will not exceed your wallet or lead credit balance on the Platform.
11. Dispute Resolution
- Payment and job disputes should be resolved directly between users.
- If unresolved, users may contact our support team for mediation assistance.
- For unresolvable issues, formal arbitration may be used.
- These Terms are governed by Canadian law, specifically those of [Province, e.g., Ontario]—court proceedings shall be held within that jurisdiction.
12. Account Suspension & Termination
- We may suspend or terminate accounts (with or without notice) if there’s a breach of the Terms or illegal behaviour.
- Upon termination, users may lose access to leads and wallet balances, unless otherwise required by law.
13. Privacy & Data
Personal data is handled under our Privacy Policy, which complies with Canadian privacy laws, including PIPEDA. The Platform collects user data for account functioning, communication, and improvement, and never sells personal information.
14. Modifications
ServiceTasker may revise these Terms at any time. We’ll notify users of significant changes via email or platform notification. Continued use implies your acceptance.
15. Notices
All legal notices to ServiceTasker should be sent to [add email]. For non-legal inquiries, use support@servicetasker.ca. Notices from us appear on the platform or through your registered email.
16. Severability & Entire Agreement
If any part of these Terms is deemed invalid or unenforceable, the remaining provisions still apply in full. These Terms, along with referenced policies, comprise the entire agreement between you and ServiceTasker.
